REFUND & CANCELLATION POLICY

ThriveVault Farm Solutions

Effective Date: 8 October 2026

At ThriveVault Farm Solutions, we aim to provide fair and transparent terms for custom-developed agricultural software.

Because our software is developed according to individually approved requirements, cancellation and refund requests are considered based on the stage of development, services already performed, the agreed project scope and applicable South African consumer protection laws.

1. Free Software Requests

Submitting a Build My Farm Software request is completely free and does not create any payment obligation.

Customers may decide not to proceed before accepting a formal development quotation.

2. Before Development Begins

Customers may request cancellation after accepting a quotation but before development begins.

Where no development or other chargeable work has commenced, payments will ordinarily be refunded in full.

Any proposed deduction must be lawful, reasonable and supported by the applicable agreement and work actually performed.

3. After Development Has Started

Where a customer requests cancellation after development has commenced, ThriveVault Farm Solutions will assess:

  • Work already completed
  • Costs reasonably incurred
  • The approved project scope
  • Any agreed cancellation provisions
  • Applicable statutory cancellation and cooling-off rights

A refund may be reduced by lawful, reasonable charges for work already performed, where permitted.

No blanket non-refundable rule applies to every custom development project.

4. Completed or Delivered Software

Once software has been completed or delivered in accordance with the approved scope, customers are not automatically entitled to a refund merely because they change their minds.

However, this does not affect any applicable statutory rights, including remedies for defective services or failure to deliver agreed functionality.

5. Software Problems and Defects

If delivered software does not materially meet its agreed specifications, customers should contact ThriveVault Farm Solutions with a description of the issue.

We will investigate and provide an appropriate remedy in accordance with the agreement and applicable law.

Depending on the circumstances, this may include correction, further performance or a refund where legally required.

6. Additional Modules

Add-on modules are subject to the same principles as custom software development.

Cancellation and refund eligibility depends on the approved scope, development progress, work performed and applicable law.

7. Annual Software Registration

The annual registration fee is R500 per independently registered software application.

A registration period runs for 12 months from the relevant application's activation date.

If an annual renewal is paid in error, charged twice or cannot be activated through a fault attributable to ThriveVault Farm Solutions, the customer should contact us for investigation and an appropriate remedy.

Refund requests for other circumstances will be considered under the agreement and applicable law. An activated annual licence is not automatically refundable on a pro-rata basis merely because the customer stops using the software.

No automatic recurring renewal payments are collected.

8. Licence Expiry and Non-Renewal

Customers may choose not to renew their annual software registration.

No new annual renewal fee becomes payable solely because an unpaid renewal invoice was issued, unless an enforceable agreement expressly provides otherwise.

If the registration expires without renewal, access to the relevant application may be suspended in accordance with the Terms of Service and the application's implemented licence controls.

Licence expiry does not authorise the deletion of customer farming data or transfer ownership of that data.

9. Statutory Consumer Rights

Nothing in this Policy excludes or restricts rights that cannot lawfully be excluded under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African legislation.

The availability of statutory cooling-off rights and any applicable exceptions depends on the nature and circumstances of the transaction.

10. How to Request Cancellation or a Refund

Please send your request to:

thrive-vault@hotmail.com

Include:

  • Your name or business name
  • Relevant order, invoice or licence reference
  • The software application concerned
  • The reason for the request
  • Any relevant supporting information

We will review the request and communicate the outcome and any next steps.

11. Approved Refunds

Where a refund is approved, we will confirm the amount and proposed repayment method.

Refunds will be processed within a reasonable period, subject to any applicable statutory deadlines, banking arrangements and verification requirements.

12. Relationship to the Terms of Service

This Policy should be read together with the ThriveVault Farm Solutions Terms of Service and the customer's approved quotation or project agreement.

If any provision conflicts with mandatory South African law, the applicable law will prevail.
